MUMBAI: An Indian-American doctor has taken on the Indian government and the Supreme Court by filing a petition in the US claiming the country’s government and the Supreme Court is “deliberately withholding” medical records from Indian doctors.In a statement to TOI, the court-appointed doctor who has written a 14-page brief on the issue, Sangeet Natrajan, said he has been “forced to rely on the Indian government and the Supreme Court to ensure his patient confidentiality”. “The government is forcing me to pay money to access information I was promised,” the doctor added.Natrajan said he was approached by the Indian government, including then Health Minister Harsh Vardhan, on November 11, 2009, to bring Indian government documents to him. Vardhan had told Natrajan that the court had ordered the disclosure of the records. He said the documents were “inconclusive” and he was told they were required as part of the case filed by Natrajan in 2011.The court later said it would get the documents only on March 3 this year, when the court, which was scheduled to hear the case on March 18, ordered their disclosure. “We are still waiting for the documents after the court ordered they be released. I have been advised not to talk to the media as it is part of the proceedings,” Natrajan said. The doctor said, “I have been in touch with several lawyers, but I am not allowed to reveal the names.”He added, “We are not even allowed to talk about the case to the press. I am allowed to tell my story only to the Indian court.” Natrajan wrote a brief on January 30. The hospital he works in is not a party to the case. He said his decision to file it now came after he was summoned by a court on February 13.He said that since January 31 this year, he had gone to the US as prescribed by the court. “I was to come back March 26,” he said.
